This trade war update for October 23, 2026, leads with Treasury’s proposed rule on US investment in sensitive foreign technology, the first Russian diesel cargo bound for New York and a new EU sanctions draft.[1] It follows the October 20 trade war update; see the War Room, Trade War News Hub and Middle East war update.

Treasury Proposes Outbound Investment Rule

Treasury issued a proposed rule on October 22 to carry out the Comprehensive Outbound Investment Security Act, which Congress passed in the Fiscal Year 2026 defense bill.[29] The rule would require US persons to notify Treasury of some deals with covered foreign persons and bar others, in semiconductors and microelectronics, quantum technologies, super intelligence systems, hypersonics, high-performance computing and biotechnology.

Secretary Scott Bessent said the proposal would stop adversaries “from using U.S. investment to develop critical technologies that threaten U.S. national security.”[30] Treasury invited comments and said final rules will set the effective date. A regional outlet reported that the proposal drops Venezuela from the list of countries of concern, a detail Treasury’s release does not address.[31] The rule matters because, in Treasury’s words, the law codifies the government’s approach to US investment in technologies that benefit an adversary’s military modernization.

Trade Imbalances

Russian Deputy Prime Minister Alexander Novak said on October 21 that the first diesel tanker would soon depart for the United States, and the cargo loaded at the Baltic port of Primorsk the next day.[32] Trump has said Russia would supply over 300,000 metric tons immediately and 500,000 tons in November. The cargoes open a new US import line from Russia while the war continues.

Trump also wrote that more oil now passes through Hormuz than before the conflict, a claim this report could not check against shipping data.[33]

Critical Resources and Supply Chains

Treasury said Bessent welcomed Paraguay’s commitment to secure and resilient critical minerals supply chains when he met President Santiago Peña on October 22.[34] The State Department said Uranium Energy Corp announced a $12 million investment in one of its Paraguay uranium concessions, presenting US investment as an alternative to “predatory financing from strategic competitors.”[35]

Deals, Treaties and Agreements

Deputy Secretary of State Christopher Landau led a trade delegation to Asunción from October 19 to 21, focused on technology, critical minerals, river infrastructure and logistics.[36] In Buenos Aires on October 22, Argentina’s foreign minister linked security cooperation to the reciprocal trade and investment agreement and a critical minerals memorandum.[37] On the US-China calendar, no new Bureau of Industry and Security notice appeared, leaving the November 9 affiliates-rule date in place.[38]

Policy Economics

The EU’s diplomatic service proposed 117 listings aimed at sectors that raise revenue for Russia’s war, including 52 banks and financial institutions, and two liquefied natural gas processors; the report also cites sanctioned firms in the United Arab Emirates, Oman, Singapore and Hong Kong.[39] The EU’s top diplomat Kaja Kallas said Europe must “pressure the aggressor to stop the war, not the victim to surrender.” If adopted, the listings would ban transactions and freeze assets in the bloc.

Trade Bloc Competition and Business

China’s Commerce Ministry said US actions are “coercing US research institutions to take sides,” a dispute over rules that bar Pentagon research funding for entities working with Chinese universities on its 1286 list.[40] A Republican lawmaker asked the department to add 58 schools and 62 labs, several focused on semiconductors, AI and quantum computing. Together with Treasury’s rule, the move narrows the channels through which US money and research reach Chinese technology.

Domestic Affairs

United States

The outbound investment rule now enters a comment period, and the diesel arrangement continues to draw criticism from US lawmakers, according to the report on the first cargo.[41]

China

Beijing’s response in this window was a Commerce Ministry statement, with no announced countermeasure against US universities or investors.[42]

Assessment

Assessment: Washington is tightening technology and investment rules on China while loosening energy pressure on Russia, which puts it at odds with Brussels on Russian fuel.[43]

What to Watch (Assessment)

  • Publication of Treasury’s proposal in the Federal Register, which would start the comment clock.
  • Arrival of the first Russian diesel cargo in New York, due November 7.
  • Whether EU governments adopt the 117 sanctions listings.
  • Any BIS notice on the November 9 affiliates-rule date.

Trade War lenses

Analysis

The Trade Lenses rate US advantage from 1 to 5 where evidence allows; trends compare with the October 20 report.[2]

Deals & Agreements

No US-China trade text was signed in the window, so the deals were regional: a Paraguay package that pairs a computing project powered by the Itaipú dam with a $12 million uranium investment.[3] Argentina’s foreign minister presented a senior US visit as continuing work with the US Trade Representative, with whom Argentina signed a reciprocal trade agreement.[4]

Score 3/5Evidence confidence: MediumTrend: Stable

Imbalances & Impact

The first tanker carrying Russian diesel under the new US arrangement loaded 40,000 metric tons at Primorsk on October 22 and is due in New York on November 7, according to shipping data relayed by a wire report.[5] Critics in Kyiv, Europe and Congress argue the cargoes will do little for US consumers while funding Russia’s war.

Score 2/5Evidence confidence: MediumTrend: Worsening

Chokepoints & Dependencies

Hormuz remains the main chokepoint. Brent rose 3.2% to $112.27 a barrel on October 22 after reports of tanker damage.[6] It briefly passed $114 early on October 23.[7] China’s imports of oil labeled Malaysian, often relabeled Iranian crude, fell to 276,000 barrels a day in September from nearly 1.3 million in 2025.[8]

Score 3/5Evidence confidence: MediumTrend: Stable

Negotiating Power

Washington added a long-term investment lever while the truce holds. Treasury’s proposal would require notice of some deals and ban others in six technology areas, and Beijing answered a separate research-funding dispute only with a demand that Washington “respect the facts.”[9]

Score 3/5Evidence confidence: MediumTrend: Improving

Policy & Economics

The proposal does not take effect yet, because Treasury said final rules will set an effective date later.[10] No notice had appeared in the Federal Register by October 23.[11] The affiliates-rule suspension still ends on November 9, 2026, under the current Federal Register text.[12]

Score 3/5Evidence confidence: HighTrend: Stable

Bloc Competition

The EU moved in the opposite direction from Washington on Russian fuel, proposing 117 new sanctions listings focused on refineries, export terminals and banks soon after the US diesel arrangement.[13] The gap gives Moscow a talking point about Western division.

Score 2/5Evidence confidence: MediumTrend: Worsening

Business & Markets

US investors now face a draft compliance standard, including a “reasonable and diligent inquiry” before deals, and Treasury has asked for comments on the scope and penalties.[14] Crusoe plans to bring its first Paraguay deployment online in mid-2027.[15]

Score 3/5Evidence confidence: MediumTrend: Stable

Trade assessment

Who has the leverage
Washington on investment rules, with Beijing’s response limited to statements in this window.[16]
Biggest chokepoint
the Strait of Hormuz, where oil passed $114 a barrel on October 23.[17]
Likeliest deal
further Paraguay investment, after the State Department listed new private commitments.[18]
Main risk
a split with the EU over Russian fuel, as Brussels drafts refinery sanctions while diesel heads to New York.[19]
US interest
finalizing the outbound rule before the truce date, which Treasury Secretary Scott Bessent said in September runs to January 10, a date this report keeps attributed until an official notice confirms it.[20]

The War Department’s news feed had no trade item in this window.[48] Oil passed $114 a barrel early on October 23, its highest since mid-May.[49]
