The trade war turned on a waiver on October 16, 2026, when President Trump’s order set and then suspended a 500% duty on Russian goods and 100% duties on the top five buyers of Russian oil and gas.[1] Beijing began pre-export registration the same day for 40 artificial-intelligence, biotech and solar technologies.[2] Brussels promised new tools against its China trade deficit.[3]

Trade Imbalances

No new Census or BEA goods release fell in the window, so the January–August partner gaps in Key Numbers remain the latest official bilateral figures, with the September data due November 4.[58] Treasury capital-flow data released on October 16 show mainland China held $590.7 billion of US Treasury securities at the end of August, down from $618.0 billion in July and $699.7 billion a year earlier, a 12-month drop of $109.0 billion by our arithmetic.[59] Overall, the net TIC inflow for August was $199.8 billion, including $21.3 billion of net foreign official inflows.[60] Treasury warns that custodial data cannot attribute holdings with complete accuracy, so the Chinese decline may partly reflect bonds held through accounts in third countries.[61] On the goods side, the India figures matter for the Russian-oil decision covered below: the United States bought $68.0 billion of Indian goods in the first eight months of 2026 against $34.6 billion of exports.[62] Imports from Russia itself were only $2.2 billion over the same period, so the waived 500% duty would have reached a small base.[63]

Critical Resources and Supply Chains

China’s commerce and science ministries published a draft revision of the Catalogue of Technologies Prohibited and Restricted from Export on October 16, adding 40 technologies in artificial intelligence, biomedicine and photovoltaics.[64] MOFCOM said 14 of the items would be banned, including AI-driven malicious-code generation and perovskite and tandem cell module production, and 26 restricted, including polysilicon engineering for single lines of at least 30,000 tonnes a year.[65] The list covers 23 AI items tied to large models, agents, computing clusters and information processing, five biomedicine items and 12 solar items spanning polysilicon, wafer and cell manufacturing.[66] Exporters must register on a MOFCOM platform before transferring listed technology abroad, from the announcement date until the revised catalogue takes effect, and deals already under way are included.[67] The ministry said products made with the technologies are outside the scope and that open-source or published AI work is excluded, while offering automatic licensing for overseas data centres owned by Chinese firms and for chip tape-outs abroad.[68] Public comments run from October 16 to November 15.[69] The draft was published at 4:00 AM ET, just before this window opened, but the registration duty it created applied throughout the window.[70] On energy, the Russian-oil dependence in Who depends on whom is the supply chain most exposed to Washington’s decision: India imported about 1.82 million barrels a day of Russian crude in September against about 1.49 million for China, ship-tracking data cited by analysts show.[71]

Deals, Treaties and Agreements

Mexico’s Economy Secretary Marcelo Ebrard said on October 16 that Commerce Secretary Howard Lutnick supports lowering US tariffs on Mexico, rejecting a report from the previous day that talks had stalled.[72] That October 15 report, citing unnamed people, said Lutnick opposed deep cuts to the 25% Section 232 tariff on Mexican vehicles and the 50% duties on steel, aluminum and derivative goods.[73] Ebrard said Mexico is asking for the vehicle tariff to fall to 15% regardless of regional content and that 82% to 85% of Mexican exports to the United States already enter tariff-free.[74] Mexico had already agreed to suspend for five years its 10% tariff on imported vehicle parts for assembly, and officials on both sides denied that talks had stalled.[75]

With China, the deal calendar did not move in the window.[76] The Affiliates Rule suspension in the Federal Register still ends November 9, 2026.[77] Treasury Secretary Scott Bessent said on September 24 that the truce would be extended to January 10, 2027, a date this report keeps attributed until an official notice confirms it.[78] The September framework published by MOFCOM covers about $30 billion of imports on each side, with more than 90% of listed products to be freed of mutual additional tariffs once domestic procedures are complete.[79] On October 16, private exporters reported 558,000 tonnes of US soybean sales to China for the 2026/27 marketing year, after 470,000 tonnes on October 14 and 330,000 tonnes on October 15.[80] Those three announcements total 1.358 million tonnes by our arithmetic, though USDA does not name the buyers.[81] A weekly policy digest said Chinese state-owned trading firms made the purchases, the first since the September summit, toward a stated target of 25 million tonnes for the 2026/27 season.[82] Beijing also closed a second negotiating round, held October 12 to 16, on an upgraded economic partnership agreement with Vanuatu, reporting substantive progress on goods, rules of origin and services.[83]

Policy Economics

President Trump signed an executive order on October 16 implementing the Lindsey O. Graham Sanctioning Russia and Iran Act and, in the same order, waiving its duties and most of its sanctions.[84] The order raises the duty on goods from Russia by 500% ad valorem and imposes 100% duties on the five largest importers of Russian oil and gas that knowingly buy on or after October 18, 2026.[85] A further 100% duty applies to the top five facilitators of Russian oil sanctions evasion.[86] Each increase would stack on top of any Section 232, 301, 201 or 122 tariffs.[87] Section 4 then waives all duties under sections 112 and 113 of the Act and the sanctions in sections 102(a), 102(d), 102(e), 103 through 111 and 117, after the President certified to Congress that the waiver serves US national interests.[88] The law itself had required the duties within 30 days of its September 18 enactment, which made October 18 the deadline.[89] Existing Russia sanctions under earlier executive orders stay in force, and USTR must monitor Russian oil and gas purchases and report to the President.[90] A Treasury licence of October 9 that allows trade in Russian diesel until April 7, 2027 had already made enforcement unlikely, analysts said.[91]

Trade-remedy work continued in the Federal Register filings released on October 16 for publication on October 19.[92] Commerce’s final 2024 review of Canadian softwood lumber set dumping margins of 17.00% for Canfor, 4.71% for West Fraser and 13.13% for Resolute.[93] Its parallel subsidy review set 12.42% for Resolute and 15.31% for West Fraser.[94] A final countervailing duty determination on Chinese truck bed covers set 77.17% for Changzhou Sunwood, 11.60% for Hangzhou Golden Sun and 142.11% for six non-cooperating exporters based on adverse facts available.[95] Commerce also pushed its final dumping decision on large-diameter graphite electrodes from China to February 12, 2027 and extended provisional measures to up to six months.[96]

Trade Bloc Competition and Business

After leaders adopted conclusions on October 15 calling for new instruments against global imbalances, Commission President Ursula von der Leyen set out the follow-up at the summit’s closing press conference on October 16.[97] She said the consultations in Beijing produced China’s first agreement to moderate hybrid-vehicle exports, better access for some EU industrial and agri-food goods and more predictable rare-earth and magnet export controls.[98] She said progress in one sector cannot fix a structural imbalance and that the EU will use existing trade instruments, including more safeguards.[99] In December the Commission will present DiversifyEU, a country-agnostic de-risking tool, together with a Solidarity Mechanism for members facing coercion or retaliation.[100] Building on a Franco-German paper, it will also develop an instrument to limit access to the single market quickly when that is in the Union’s interest.[101] Diplomats said leaders discussed extending hybrid-style safeguards to chemicals, machine tools, silicon and plastics, an account tagged reported.[102] MOFCOM answered on October 16 that the hybrid understanding was reciprocal under WTO rules and that claims EU pressure had worked are baseless.[103] It urged Brussels not to underestimate China’s determination and ability to defend its interests, a statement tagged reported.[104]

For business, the National Association of Home Builders welcomed lower lumber rates but urged the administration to suspend tariffs on all building materials and negotiate a duty-free lumber agreement with Canada.[105] Indian refiners are expected to keep Russian crude intake near current levels after the waiver, with September’s Urals discount to Brent averaging $23 a barrel, analysts said.[106] Late on October 16 the Nasdaq was down 2.19% and the Philadelphia semiconductor index 2.5%, in selling the market report linked to AI financing worries and higher oil.[107]

Domestic Affairs

United States

The Graham Act waiver is the main domestic political development, since it sets aside a law the President signed on September 18 by using the waiver power in its section 115.[108] The order also delegates Graham Act functions to the Secretaries of State, the Treasury and Energy and to the Trade Representative.[109] Trade Representative Jamieson Greer told the G20 Interfaith Forum in Utah on October 16 that past trade policies drove production offshore and harmed communities.[110] No new tariff proclamation, USTR Section 301 action or Commerce Section 232 notice appeared on the official lists checked for the window.[111]

China

Beyond the export catalogue covered above, MOFCOM’s two October 16 statements kept the official line that trade friction should be handled through talks while warning the EU against pressure.[112] The ministry cited Article 20 of China’s Foreign Trade Law, called the revision routine and said it targets no particular country, a claim tagged reported.[113]

Assessment

Assessment: US trade policy in the window relied on administrative remedies and a sanctions waiver rather than new tariffs, since the largest US actions found were the Graham Act order and Commerce’s lumber and truck bed cover findings.[114] Assessment: China’s technology catalogue adds a licensing lever that Beijing can tighten or relax, which raises the value of November’s US–China calendar for solar and AI supply chains.[115]

What to Watch (Assessment)

  • Whether USTR’s monitoring report names any of the top five Russian oil buyers or evasion facilitators, the first step that could reverse the October 16 waiver.[123]
  • Comments on China’s technology catalogue before November 15 and any first licence refusals under the new registration rule for solar equipment.[124]
  • Publication of the lumber and truck bed cover findings on October 19 and the cash-deposit instructions that follow.[125]
  • A US–Mexico Section 232 announcement on vehicles and metals, which Ebrard said could come in weeks or months.[126]
  • Any BIS notice moving the November 9 Affiliates Rule date toward January 10, and the November 4 Census release for September balances.[127]
  • The Commission’s December DiversifyEU proposal and any new EU safeguard case on chemicals, machine tools, silicon or plastics.[128]

Trade War lenses

Analysis

Seven Trade Lenses rate US advantage from 1 to 5 where evidence allows; trend is measured against the October 16 trade war update, and all theaters are on the War Room dashboard.[4]

Deals & Agreements

No signed US–China text changed in the window, so the Federal Register still dates the end of the Affiliates Rule suspension to November 9, 2026, while the January 10, 2027 truce date remains Secretary Bessent’s attributed statement.[5] The mechanism is calendar risk: exporters must plan to the published date until a notice moves it, which keeps November a live bargaining point.[6] For US interests, the October 16 soybean sale is the window’s one tangible delivery, though it is a purchase record, not a tariff commitment.[7]

Score 3/5Evidence confidence: MediumTrend: Stable

Imbalances & Impact

With no new Census data, the window’s imbalance news is financial: China’s US Treasury holdings fell for a third straight month in August.[8] A smaller Chinese Treasury stock is consistent with less recycling of China’s goods surplus into US government debt, but custodial data cannot show whether bonds moved to third-country accounts.[9] For US interests, overall foreign demand stayed strong, with net foreign purchases of long-term US securities of $300.7 billion in August, so the Chinese decline left no visible strain on total foreign demand in August.[10]

Score 3/5Evidence confidence: HighTrend: Stable

Chokepoints & Dependencies

Beijing’s draft technology catalogue extends China’s control from minerals to manufacturing processes, from perovskite cells to large polysilicon lines.[11] Because registration began on October 16 and finished products are excluded, the immediate effect falls on plant sales, licensing and line upgrades abroad rather than on module trade.[12] For US interests, solar and AI firms relying on Chinese process engineering now face a second licence gate on top of the rare-earth dependence listed under Who depends on whom; the draft gives no substitution timeline.[13]

Score 2/5Evidence confidence: MediumTrend: Worsening

Negotiating Power

Assessed: Washington set aside near-term leverage over Russian-oil buyers by waiving duties the law required within 30 days, while keeping USTR monitoring in place.[14] India, the largest seaborne buyer of Russian crude, therefore avoids an immediate 100% US duty, and analysts expect its October volumes near 1.8 to 1.9 million barrels a day.[15] For US interests the waiver can be reversed by the President or the Secretary of State, so the threat survives as a dormant option rather than a cost now borne by importers.[16]

Score 3/5Evidence confidence: MediumTrend: Worsening

Policy & Economics

Commerce’s final lumber review cuts the combined duty on non-selected Canadian exporters to about 24.75% from about 35.16%, by the home builders’ count.[17] The lower rates reduce deposits on a building input that builders say already raises housing costs, but a separate 10% Section 232 lumber duty lifts their total to about 34.75%.[18] For US interests, subsidy rates as high as 142.11% on some Chinese truck bed cover exporters show remedy law still doing more trade-protection work than new tariffs in this window.[19]

Score 3/5Evidence confidence: HighTrend: Stable

Bloc Competition

The Commission’s October 16 pledge of more safeguards and new instruments, detailed under Trade Bloc Competition and Business, moves the EU closer to US-style remedies against Chinese overcapacity.[20] MOFCOM’s reply that the EU should not expect pressure to buy benefits suggests the hybrid-car understanding has not settled the wider China file.[21] For US interests a tougher EU stance on overcapacity aligns with US remedies; the limit is that no new EU safeguard was adopted in the window.[22]

Score 4/5Evidence confidence: MediumTrend: Improving

Business & Markets

Builders, refiners and farm exporters were the business groups most directly touched in the window, through lumber duty cuts, the Russian-oil waiver and Chinese soybean bookings.[23] Market moves were not tied to trade news in the reporting opened, as the chip-stock slide noted under Trade Bloc Competition and Business shows.[24] For US interests, the soybean sales support farm income, but state-firm buying does not show whether private Chinese buyers will return while an additional 10% Chinese tariff on US soybeans remains.[25]

Score 3/5Evidence confidence: LowTrend: Stable

Trade assessment

Who has the leverage
contested; the US set aside an immediate Russian-oil tariff threat, while China added a technology-export gate and resumed soybean buying on its own schedule.[26]
Biggest chokepoint
Chinese process technology for polysilicon, wafers and solar cells, now under a registration rule that runs until the catalogue is finalized.[27]
Likeliest deal
a US–Mexico Section 232 arrangement on autos and metals, which Mexico’s economy minister said could come within weeks or months.[28]
Main risk
an EU single-market access tool aimed at China that triggers Chinese counter-measures, given MOFCOM’s warning not to underestimate Beijing’s resolve.[29]
US interest
a published notice moving the November 9 Affiliates Rule date before it lapses, while Chinese soybean buying continues.[30]
