Ilhan Omar, a Democrat, has represented Minnesota’s 5th Congressional District, which includes Minneapolis and surrounding suburbs, since January 2019. Her House office describes her as the first African refugee to become a member of Congress.[3]
Born in Somalia, she fled the civil war with her family at age 8, spent four years in a refugee camp in Kenya and moved to Minneapolis in 1997. She sits on the House Budget Committee and the Education and Workforce Committee and is deputy chair of the Congressional Progressive Caucus.[3]
What the investigation and the court filings are
DOJ has confirmed only that the Oct. 12 search was part of “an ongoing federal criminal investigation” (quoted in full below).[6] It has not publicly named an offense. People familiar with the probe have told reporters it concerns immigration paperwork her late father completed when she was a child, which officials have not confirmed on the record.[7] Homeland Security Investigations (HSI), the agency that executed the warrant, is the criminal investigative arm of ICE within DHS.[5]
No criminal case has been opened in court. The public cases are three miscellaneous matters in the U.S. District Court for the District of Columbia, all before Chief Judge James E. Boasberg, in which outside parties are asking for the warrant records to be released:[2]
| Case no. | Applicant | Filed |
|---|---|---|
| 1:26-mc-00144 | Fourteen press organizations | Oct. 15, 2026 |
| 1:26-mc-00145 | The New York Times Company | Oct. 15, 2026 |
| 1:26-mc-00147 | Judicial Watch, Inc. | Oct. 15, 2026 |
What is public: the dockets, the applications, and DOJ’s three-page Oct. 21 motion asking to delay its response until “after the subject search warrant has been fully executed,” with a status report within 30 days of that point. The motion says the applicants oppose it.[1]
What is sealed: the warrant itself, its application and supporting affidavits.[1][7] DOJ’s memorandum explaining its request also remains sealed and was filed ex parte, meaning without the other side seeing it.[1][8]

Long-running allegations and what records show
Each item below is an allegation, not a finding. None has been tested in court.
The “married her brother” claimALLEGATION
- The claim
- Since 2016, websites have claimed that Omar’s former husband, Ahmed Nur Said Elmi, is her brother and that the marriage was meant to help him immigrate. Trump has repeated the claim.
- Omar’s response
- Omar has called it “absurd and offensive” and “disgusting lies.” Asked on MS NOW whether she was related to Elmi, she said, “Not to my knowledge”; her spokesperson said that answer was sarcastic and that she has “repeatedly and unequivocally” denied the claim.
- What records show
- No public record shows the two are related. The Guardian calls the claim unsubstantiated, and Yahoo News reports that fact-checkers found no credible evidence for it.[7][9][6]
The “Ilhan Nur Said Elmi” nameALLEGATION
- The claim
- DOJ’s Oct. 21 motion names her “Congresswoman Ilhan Nur Said Elmi, a/k/a Ilhan Abdullahi Omar.” Fox News, citing two people familiar with the probe, reported that this is her birth name.
- Omar’s response
- Her office says, “Ilhan Omar is her real name.”
- What records show
- The filing does not explain the name, and no document supporting it has been made public. The detailed background is in our post on the filing’s wording.[1][9]
Age and paperwork at naturalizationALLEGATION
- The claim
- The Washington Post reported, citing people familiar with the inquiry, that investigators are examining whether her father or Omar misstated her birthdate so that she would qualify as a minor; that account is unconfirmed.
- Omar’s response
- Omar told MS NOW, “I’m confident in the fact that I didn’t do anything wrong,” and noted that federal immigration officials “literally have his papers.”
- What records show
- According to the Post, a U.S. Citizenship and Immigration Services officer reviewed her file during Trump’s first term and wrote a one-page memo that found no problems. That memo has not been published.[7]
Financial disclosuresALLEGATION
- The claim
- Pirro’s office has said “there are several investigations going on” involving Omar, including one into her financial disclosures.
- Omar’s response
- Omar amended her 2025 disclosure, citing accounting errors, Yahoo News reported.
- What records show
- According to TMZ, as cited by Yahoo News, the Office of Congressional Conduct board voted 5 to 1 to recommend that the House Ethics Committee dismiss the allegation that she filed false information.[7]
What comes next
Instead of waiting until the warrant is fully executed, as DOJ asked, Judge Boasberg set firm dates, while noting that prosecutors could “argue in part that the Court should not address the matter yet.”[8]
After the briefs are in, the judge can unseal the records, release them with redactions, or keep them sealed. A federal felony charge would require a grand jury indictment, and none has been reported.
Frequently asked questions
Has Ilhan Omar been charged with a crime?
No. As of Oct. 24, 2026, no charge, indictment or denaturalization suit had been filed, and she denies wrongdoing.[9]
Who is running the investigation?
DOJ obtained the warrant, and HSI executed it. The U.S. Attorney’s Office for D.C., led by Jeanine Pirro, is handling the court filings.[6][1]
What did agents take?
The inventory is sealed. Omar told MS NOW that agents took 17 items, mostly phones and notebooks. Fox News reported that her phone and passport were seized.[7][9]
Why is the search warrant sealed?
DOJ has argued that releasing the records now would jeopardize an investigation that is not finished, the Daily Wire reported. Its full reasons are in a memorandum the judge has allowed to stay sealed.[8]
Can she keep running for Congress?
Yes. She is on the Nov. 3 ballot seeking a fifth term.[7]
What law could apply?
No prosecutor has named one. Legal commentators have pointed to 18 U.S.C. 1425, which covers knowingly procuring naturalization “contrary to law.”[4] Our filing explainer covers that law, the time limit and civil denaturalization.
